The Position
The IBM Law Department is seeking an experienced competition law attorney with a minimum of seven (7) years’ experience as in-house corporate counsel, at a law firm, competition law regulator or equivalent experience, to serve as the leader of the IBM Law Department’s virtual competition law team and provide advice and counsel to IBM senior business leaders on related matters.
The position may be located in Armonk (NY), New York City, Washington DC, Raleigh (NC), or Austin (TX).
· Act as subject matter expert to the IBM Law Department across the entire spectrum of competition law matters, including:
o merger clearances and foreign direct investment screenings for global M&A transactions;
o global competitive conduct investigations;
o Robinson-Patman Act compliance and practical handling of distribution issues,
o dealings with competitors, suppliers and customers;
o competitive intelligence practices; and
o implications of new developments in antitrust and competition law and related enforcement trends.
· Review and re-imagination of IBM’s competition law policies and practices at the global level.
· Coordinate with the IBM Law Department’s global virtual team and collaborate with internal and external counsel in support of global competition law matters, including in support of M&A transactions and other commercial matters, interactions with regulators and investigations or enforcement matters.
· Provide proactive guidance on changes in international competition laws and risk mitigation strategies
· Maintain strong relationships within the competition law ecosystem, manage a strong bench of external counsel and serve as a leading IBM voice on competition law matters externally.
· Develop compliance programs for the business and provide competition law-related education and guidance materials for the Law Department and business audiences
· J.D. with at least seven (7) years’ experience as in-house corporate counsel, at a law firm, competition law regulator or equivalent experience, preferably with exposure to the technology industry.
· License to practice law in a US jurisdiction, preferably New York.
· You will also need to have demonstrated the following capabilities:
o Excellent drafting, negotiation and communication skills, including the ability to think on your feet;
o Sharp analytical skills with the ability to identify and resolve issues with creativity, diligence and speed;
o Solid business judgment and ability to prioritize in a fast-paced environment;
o Expertise in US and global competition laws and regulatory systems;
o Experience leading collaborations across a diverse set of stakeholders;
o Experience developing and driving compliance programs and responding to government investigations and
o A positive, collaborative attitude and a sense of humor.

The compensation range and benefits for this position are based on a full-time schedule for a full calendar year. The salary will vary depending on your job-related skills, experience and location. Pay increment and frequency of pay will be in accordance with employment classification and applicable laws. For part time roles, your compensation and benefits will be adjusted to reflect your hours. Benefits may be pro-rated for those who start working during the calendar year.
